Regarding Distance Selling Contracts and Electronic Commerce with Schäfer + Peters GmbH
Schäfer + Peters GmbH, Zeilbaumweg 32, D-74613 Öhringen, maintains an Internet website at shop.schaefer-peters.com that entrepreneurs can visit to acquire fastening components, among other products. The offering is not designed to target consumers. A consumer is any individual person who engages in a legal transaction for purposes that largely cannot be attributed to the person’s commercial or independent professional activity. To the extent that Schäfer + Peters GmbH renders services by way of distance selling contracts, it shall also be obligated to provide the corresponding information as follows:

The German language shall be exclusively applicable to the conclusion of the contract. Our Internet offering (shop.schaefer-peters.com) targets individuals, legal entities and legal business partnerships which conduct themselves in the exercise of their commercial or independent professional activities following conclusion of the corresponding legal transaction as well as legal entities and special funds under public law with headquarters located in Germany.The products and services presented on our Internet site, in our sales brochures and other documentation do not represent a binding offer, but rather an invitation to the customer to submit offers, unless an offer discernibly created for a specific customer is made available.
The binding proposal is presented by the customer using the order process provided on the shop.schaefer-peters.com Internet site.
The offer is accepted by Schäfer + Peters GmbH via e-mail, phone, fax or other written form but at the very latest when the products are shipped.
The following technical steps are followed for an order:
a. Log on to web shop
The customer can only access the web shop after they have been notified in writing and/or by e-mail, phone or fax that web shop access details have been created for them. The customer is then provided with the access data that they can use to log on to the shop.schaefer-peters.de page in the “Mein Konto” (my account) area. The customer does not have a legal right to this access data. As such, Schäfer + Peters can deny access or revoke it at any time.
b. Order process
As soon as the customer has been created and enabled as a user by Schäfer + Peters GmbH, they can log on using their access data, search for products on the Internet site and place them in the shopping cart by clicking the “In den Warenkorb” (add to shopping cart) button.
The customer can view the content of the shopping cart at any time by clicking the “Warenkorb” (shopping cart) button. The customer can click the “Löschen” (delete) button (an “x”) at any time to remove selected products from the shopping cart or adapt the quantity. To initiate the order process, the customer clicks the “Nächster Schritt” (next step) button until they are taken to the “Bestellen” (order) page in step 3.
During the order process, the customer must specify their preferred method of payment, their person/company, billing address and delivery address. On the last page, they are once again allowed to review what they would like to order and make changes to incorrectly entered data, for example. To do this, the customer simply clicks the “Zurück” (back) button to go back to the shopping cart.
Only once the “Kostenpflichtig bestellen” (place order) button is clicked does the customer complete the order process and allows Schäfer + Peters GmbH to conclude a purchase contract.
Since there could be price changes between the time of clicking the button "Add to cart" and "Order with costs", we point out that the displayed prices before the completion of the ordering process are valid for the offer to purchase contract.
The customer can cancel the order process at any time before the order is formally placed by simply closing the Internet site in their browser.
c. Order confirmation
Pursuant to 312i, sec. 1, no. 4 of the German Civil Code, Schäfer + Peters GmbH is legally obligated to immediately confirm by electronic means that an order has been received for contracts involving electronic commerce. This order confirmation does not implicate that the offer from the customer has been accepted. In this confirmation e-mail, Schäfer + Peters GmbH provides the customer with additional information regarding their order and the following documents - if available and relevant in the case in question - in written form:
• Contractual provisions, including the general terms and conditions
• Statutory information for distance selling contracts and contracts involving electronic commerce
• Data protection declaration
d. Offer acceptance
The offer is accepted by Schäfer + Peters GmbH via e-mail, phone, fax or other written form no later than when the products are shipped.
Schäfer + Peters GmbH saves the contract text for internal purposes. The customer contract is not saved permanently. The contract text is once again shown on screen to the customer as soon as the order is placed to give them the opportunity to save it in reproducible form and/or to print it out. The general terms and conditions of Schäfer + Peters GmbH and corresponding data protection declaration are also available on the Internet site to be saved and/or printed out.
3. Right of revocation
The offering of Schäfer + Peters GmbH targets exclusively individuals who are not engaging in private consumer activity. As such, the contractual partners are not entitled to the legal right of revocation.4. Key characteristics of the offering
